TERMS & CONDITIONS – AUSTRALIA DAY PRIZE DRAW
Any entry into the Australia Day Prize Draw is deemed an acceptance of these Terms & Conditions. Information on the draw and how to enter form part of these Terms & Conditions. Entries not completed in accordance with these Terms & Conditions are ineligible.
1. The promoter is Chemtools® Pty Ltd (‘Chemtools®’), ABN 12 114 400 083, Unit 2, 14 – 16 Lee Holm Road, ST MARYS NSW 2760.
2. Entries are open to Australian residents only. All employees of the promoter and of authorised Chemtools® distributors are ineligible to enter.
3. To submit an entry:
a. Entrants must have purchased any Chemtools® product from authorised Chemtools® distributors in Australia between the promotion period of 1st December 2020 and 15th January 2021.
b. Entries must be made online at www.chemtools.com.au/prize-draw-entry-form before 12pm noon on 18th January 2021. Entrants must correctly complete the prize draw entry form and are required to upload a copy of a valid Tax Invoice as proof of purchase, which clearly show details of the invoice number, invoice date, store of purchase, Chemtools® product/s purchased, and the purchased quantity.
4. Multiple entries are permitted provided that each one is made with a unique Tax Invoice.
5. Entries will be verified within 1 business day and entrants will receive a unique prize draw entry code via email after verification. Entries submitted using the same Tax Invoice as used previously will not be validated and will be declared void.
6. The winning entry will be drawn no later than 1 business day after the draw’s closing date (as specified in 3b.). Winners will be notified in writing via the email address provided on the winning entry.
7. If Chemtools® receives no response from the winner/s within 4 business days, the promoter reserves the right to re–draw and select another winner. The re–draw process may occur any number of times until a winner has been confirmed via return contact. After confirmation, the winning entrant/s will be announced online at www.chemtools.com.au.
8. Prizes may take up to 8 weeks to be dispatched to the nominated delivery address on the agreed date.
9. It is a condition of entry to understand that: (a) the address provided on the prize draw entry form must be that of an occupied premise and not a post office box. Entries will be declared instantly void if a post office box is provided; (b) someone must be available during business hours to accept the delivery; (c) prizes will not be delivered and left unattended, and all consecutive attempts at delivery are to be rescheduled and charged at the expense of the winning entrant/s.
10. Chemtools® accepts no responsibility for any lost, misdirected, delayed, or misplaced delivery due to an incorrectly provided delivery address and/or any absence to sign for the delivery.

12. Chemtools® accepts no responsibility for entries not properly completed or received. Entries that are illegible, incomplete, fraudulent, or received by the promoter after the closing date (as specified in 3b.) are declared void.
13. Chemtools® reserves the right to substitute the prize for that of a similar item of equivalent value at its discretion in the event of happenings beyond its control. The prize, or its equivalent, is not exchangeable, transferable, nor redeemable for cash.
14. Chemtools® reserves the right to check the validity of all entries and reserves the right to disqualify any entrant for tampering with the drawing process or for submitting an entry which does not comply with these Terms & Conditions. Failure to produce the original Tax Invoice as proof of purchase (if requested) may, at the absolute discretion of the Chemtools® Director, result in invalidation of the entry and/or prize/s. If there is a dispute as to the validity of any prize draw entry, the decision of the Chemtools® Director is final, and no correspondence will be entered into after this time.
15. Except for any liability that cannot be excluded by law, Chemtools® and its related bodies corporate (including their officers, employees, authorised distributors, and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special, or consequential, arising in any way out of any won item, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the promoter’s control); (b) any theft, unauthorised access, or third party interference; (c) any prize draw entry that is late, lost, altered, damaged, or misdirected (whether or not after its receipt by Chemtools®) due to any reason beyond the reasonable control of the promoter; (d) any variation in prize item value to that stated in these Terms & Conditions; (e) any tax liability incurred by the winning entrant; or (f) use of the won item.
16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the promoter, Chemtools® reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any prize draw entry; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
17. Chemtools® collects personal information in connection with this promotion in order to conduct the promotion. Chemtools® may, for an indefinite period, unless otherwise advised, use the information provided for promotional, marketing, publicity, research, and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update, or correct information via email to sales@chemtools.com.au.
