TERMS & CONDITIONS: FREE AEROGUN PROMOTION

Any claim for redemption of bonus products is deemed as acceptance of these Terms & Conditions. Information on the bonus item/s and how to make a claim form part of these Terms & Conditions. Claims not completed in accordance with these Terms & Conditions are ineligible.
1. The promoter is Chemtools® Pty Ltd (‘Chemtools®’), ABN 12 114 400 083, Unit 2, 14 – 16 Lee Holm Road, ST MARYS NSW 2760.
2. Offers are open to Australian residents only. All employees of the promoter and of authorised Chemtools® distributors are ineligible to claim.
3. To submit a claim:
a. Claimants must have purchased no less than the minimum quantity of the promoted item/s, per Tax Invoice, from authorised Chemtools® distributors in Australia between the promotion period of 1st December 2020 and 31st December 2020.
b. Redemptions must be made online at www.chemtools.com.au/bonus-redemption-form. The closing date for online redemptions is 15th January 2021. Claimants must correctly complete the online redemption form and are required to upload a copy of a valid Tax Invoice as proof of purchase, which clearly show details of the invoice number, invoice date, store of purchase, Chemtools® product/s purchased, and the purchased quantity.
4. All redeemable items are strictly not for resale.
5. Multiple claims are permitted but limited to a total of 10 redemptions per customer, per promotion period (as specified in 3a.) provided that each claim is made with a unique Tax Invoice. Claims submitted using the same Tax Invoice as used previously will not be validated.
6. Any unclaimed redeemable items will remain the property of the promoter.
7. Please allow 2 – 4 weeks from the date of each claim submission for Chemtools® to assess and validate each claim and dispatch the redeemed item/s to the nominated delivery address.
8. Claimants must ensure that someone will be available during business hours to sign for the delivery. An unanswered door will result in the parcel being left unattended.
9. Chemtools® accepts no responsibility for any lost, misdirected, delayed, or misplaced delivery due to an incorrectly provided delivery address and/or any absence to sign for the delivery.

11. Chemtools® accepts no responsibility for claims not properly completed or received. Claims that are illegible, incomplete, fraudulent, or received by the promoter after the closing date (as specified in 3b.) are declared void.
12. Chemtools® reserves the right to substitute the advertised bonus item/s for a gift of equivalent value at its discretion in the event of happenings beyond its control. The bonus item, or its equivalent, is not exchangeable, transferable, nor redeemable for cash.
13. Chemtools® reserves the right to check the validity of all claims and reserves the right to disqualify any claimant for tampering with the redemption process or for submitting a claim which does not comply with these Terms & Conditions. Failure to produce the original Tax Invoice for a redemption (if requested) may, at the absolute discretion of the Chemtools® Director, result in invalidation of the, some, or all of the claimant’s redemption/s and forfeiture of any right to the, some, or all bonus item/s. If there is a dispute as to the validity of any claim submitted, the decision of the Chemtools® Director is final, and no correspondence will be entered into after this time.
14. Except for any liability that cannot be excluded by law, Chemtools® and its related bodies corporate (including their officers, employees, authorised distributors, and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special, or consequential, arising in any way out of any redemption, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the promoter’s control); (b) any theft, unauthorised access, or third party interference; (c) any claim for redemption that is late, lost, altered, damaged, or misdirected (whether or not after its receipt by Chemtools®) due to any reason beyond the reasonable control of the promoter; (d) any variation in bonus item value to that stated in these Terms & Conditions; (e) any tax liability incurred by the claimant; or (f) use of the bonus item/s.
15. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the promoter, Chemtools® reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any redemption claim; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
16. Chemtools® collects personal information in connection with this promotion in order to conduct the promotion. Chemtools® may, for an indefinite period, unless otherwise advised, use the information provided for promotional, marketing, publicity, research, and profiling purposes, including sending electronic messages or telephoning the claimant. Claimants should direct any request to opt out, access, update, or correct information via email to sales@chemtools.com.au.
